No one can practice homeopathy in Delhi without registration with the Delhi Homoeopathic Board. Anyone having a registration with the board, may be on experience basis, one is lawfully entitled for practicing homeopathy, but any person practicing without any registration it is illegal. If you are sure that any person practicing in your area is not having proper registration you may complain about the same to the anti-quackery cell of the government or to the Delhi Homeopathic Board, necessary action against such persons can be taken. It is serving and has treated many patients since 1948. The coaching was very systematic, covering wide range of subjects. All subjects were dealt in its entirety. After each 30-35 lessons, tests were conducted. On completion of the course in one year, the final exams were conducted. I passed securing first class and after completion of clinical training at the mission, I was awarded Diploma in Homoeopathy and Biochemistry. I have also treated good number of patients successfully and some complicated cases, which were not cured by allopathy also. The Mission says with this Diploma we can practice homoeopathy, as Central Act does not prohibit lay practice of homoeopathy. Based on this certificate Indian Council of Alternative Medicines, Kolkatta, has granted registration as RMP in biochemic system of medicine. As you are registered in Tamil Nadu and intend to practice for 3 days in Kerala what you are required to do is to get permission from the State Govt. of Kerala for practicing in the Kerala on the basis of your registration in Part B of Central Register maintained by Central Council of Homoeopathy. You are required to write a letter to Secretary, Central Council of Homoeopathy enclosing your registration certificate issued by Tamil Nadu Homoeopathic council for knowing your registration number in the Central Register of Homeopathy. on the basis of your registration number in the Central Register you may apply to the Kerala Govt. for permission to practice and there is no need for registration in Kerala. In a homoeopathy magazine in Malayalam language, a method applying medicines is reported by a homoeopathic doctor that medicines can be applied through photographs, hair etc. of a distanced patient or through phone to the distanced patient. I am suffering from chronic constipation for last about ten years and to ease myself in the morning I am to take ‘Kayam churan’ daily at bedtime. I passed BHMS from Muzaffarpur University in 2001 and I got registration from Homoeopathic Board, Patna. I want to know what is the schedule I, II, III of the Homoeopathy Central Council Act 1973? Which colleges come under these schedules and what is meant by the recognition of the college? Do doctors who are registered under Bihar Homoe- opathic Board come under schedule II or III of Homoeopathy Central Council Act 1973 and can they practice in any other state? If any person has his BHMS completed in other state, is he allowed to practice in his own state without his state board registration? Dr. A.K. Mandal All the colleges in India are recognized by Central Council of Homoeopathy as per the provisions of Homoeopathy Central Council Act 1973. The colleges are also recognized by the respective universities or state boards for the purpose of examinations and award of degree qualification. The qualifications awarded by the universities are included in the IInd schedule of Homoeopathy. If a person possesses qualification included in the second schedule of homoeopathy, he can practice anywhere in India without any restriction, however he is also required to get himself registered with the respective state board. Schedule “I” relates to the number of seats allotted to different states in the Central Council of Homoeopathy and nothing do with the registration of homoeopathic doctors. I am a registered homoeopathic medical practitioner registered in Homoeopathic Council of Tamil Nadu under class B: year 1976. Last year I came to know through one of my friends that they are renewing the registration and issuing identity cards etc.. So I personally went to Chennai and enquired at the Council office. They say that they cannot renew my registration since I am residing in Kerala. They would only renew registration whose address is in Tamil Nadu whose address is in Tamil Nadu but in the late 80’s I had to leave Tamil Nadu and settle in Kerala. I had informed them about my change of address which they had changed and used to send me ballot papers etc. to my new Kerala address. The address now in their register is the Kerala address. Even then they refuse to renew my medical registration. I am afraid I may lose my consequent benefits if my registration is not renewed. Kindly advise me what should I do and oblige? Dr. K.S. Chandrasekhran The doctors who were registered in the Part B of the State Register and are also having their registration in the Part - B of the central register maintained by Central Council of Homoeopathy as per the provisions of the Homoeopathy Central Council Act, 1973 are entitled to practice in the respective state or in any other state with the formal approval of the respective State Government where one intends to practice. The rights of such persons have been safeguarded as per the provision 26 (2) (b) of the CCH Act, 1973. As regards your change of address is concerned it is apparent that the board has already changed your address in their record as they are sending the letters and election notices on the new address. The state board is also required to renew your registration if at all they are doing. It will be pertinent to mention that if you are also required to take approval from the Govt. of Kerala for practicing at the new address. I have qualified (BHMS) from Karnataka and am presently registered under the State Board in Karnataka. I would like to set up a private clinic in Kerala. Do I require a separate registration from Kerala. In fact I have applied for the state Board in Kerala for registration, but on enquiry they say that it will come through only by January 2004. Does this bar me from practicing till I get my registration? Also let me know if homoeopaths need any other license to keep and sell homo- eopathic medicines - especially patents like cough syrup (for patients) in the private clinic? Dr. Sara The rights of qualified doctor who has already been registered in one state are covered in the provisions in section 15(1) of Central Council of Homoeopathy Act., 1973 which states as under “..... 15. (1) - Subject to the other provisions contained in this Act, any medical qualification included in the Second or the Third Schedule shall be sufficient qualification for enrolment on any Sate Register of Homoeopathy.” It is apparent from the above that there is no need for re-registration with every state government where one intends to practice, so you can legally practice in Kerala as long as you want. The homoeopathic doctor can always keep homoeopathic drugs which include patents also for dispensing to his patients and is not required to take any drug license. However if you want to sell homoeopathic drugs to general public there is a requirement for taking sale license from the drug controller of the respective state. My son is studying in III year BHMS at a reputed homoeopathic medical college at Pune, affiliated to Maharashtra University of Health Sciences. We have recently come to know, much to our shock, that several of the renowned homoeopathic colleges are not approved by the Central Council of Homoeopathy, as the colleges do not have an attached exclusive homoeopathic hospital, although they are attached to a multi-disciplinary hospital having homoeopathic, allopathic, ayurvedic OPDs. As a result of this lack of recognition, the students will not be registered under CCH at all India level, but will only be registered by the Maharashtra State Council for Homoeopathy. As such, they will be licensed to practice only within Maharashtra, and not in any other state. They will also not be admitted to M.D. (Hom) courses in other states. We were not informed of this problem by the college authorities at the time of my son’s admission, but only came to learn of this matter recently. As this is likely to have an adverse effect upon my son’s future scholastic and medical career, would you kindly enlighten us on the following: a) Can a student registered by the Maharashtra State Council for Homoeopathy practice in the other states in India? Is there any provision for obtaining registration in some other State Council for Homoeopathy, in case he desires to study further or to practice homoeopathic medicine in some other state of India? b) Which are the other countries where an Indian BHMS graduate can practice homoeopathic medicine, if registered with the state council? K.C. Shah The Central Council of Homoeopathy recently has not recognized any college of Maharashtra State and it appears you are not fully informed. However even for registration in any State Boards/Council say Maharashtra Council, it is essential to hold a recognized qualification in homoeopathy. Professional qualifications like BHMS are governed by the Central Govt, through the councils. Therefore it is not appropriate if a college is having recognition from State Council and the University without recognition from the Central Council of Homoeopathy. I am a homoeopath having class B registration from Nagaland. When I approached the Chhattisgarh Council for registration, they are of the opinion that my registration is Nagaland in under section 22/2 and vide CCH letter no. 13-12/2001/3029 dt. 24.4.03, homoeopaths registered under section 22/2 in Nagaland is not incorporated in the Central Register. Hence they are not in a position to register me. I shall be grateful if you could kindly guide as to what is to be done, as many poor people approach for homoeopathic treatment, this being a very backward area and I am running a charity clinic of my own. I came to know that homoeopathy is used for agricultural crops/ ornamental plants against pest disease and nutritional deficiencies of all crops. You had mentioned in the Readers Queries column of Homoeopathy for All - October 2003 that Osteoarthritis could be cured by Homoeopathy. I have hypothyroidism for which I take one tablet of Eltroxin every morning. My blood pressure is 140/80, for which I take Tenormin 50 - 1, and Losacar 25 - 1 tablet every morning. My weight is 80 KG. and Height 5 ft 2". In June 2003 I suddenly had a weakness in the right knee & could not walk without dragging my leg. There was tension in the calf muscle & rt. ankle & foot were also swollen. The Doppler test showed no blood clots and the diagnosis was Osteoarthritis. Since my knees are stiff I am taking Causticum 200. I would like to know, how long I should take it? Can you suggest more appropriate medicines and how long should I take them? Do you recommend OA Nosode? At present I can only walk inside the house, as I am not too steady on my feet. The knees are stiff and the ankles get swollen sometimes. I find relief when I lie on my back in bed, and keep a small pillow under my thigh, which gives support to the hollow under the knee. I also find relief when I draw up my foot, by bending my knee while resting in bed. Since I am over weight, can you suggest line of treatment? Flavia Soans. Medical Practitioners (RMP) Regd. under ‘Part B’ from the Board of Homoeopathic System of Medicine, Nagaland in relation to their subsequent Registration in the respective State Council or in the Central Council of Homoeopathy, Delhi. In other words, I request you to kindly advice what your policy is for such Regd. Practitioners. -Dr. Shyamal Kumar Dutta The registered medical practitioners from any state Board are entitled to practice in respective states without any subsequent re-registration with the Central Council of Homoeopathy. Such practitioners if intend to practice in other states, they are required permission from the respective State Government on the basis of their name in the Part B Central Register of Homoeopathy. The Part B of the Central Register is being maintained by Central Council of Homoeopathy on the basis of the information received from all the State Boards in respect of registered medical practitioners. I request you to enlighten me on the following points 1. As I understand, presently practicing of Homoeopathy Medicine as profession without appropriate educational qualification from a recognized Homoeo Educational institution and without registration as Homoeopathic Doctor is against law and prohibited. 2. If self-medication of Homoeo drugs without any prescription or guidance from a qualified Homoeo Medical Practitioner also come under the ambit or law as prohibited act? 3. If any person resorts to self-medication of Homoeo drugs without the recognized qualification to practice as Homoeopathic doctor and without any prescription or guidance from a qualified Medical Practioner, what are the consequences under the law and also for the family members such as parents of such person who couldn’t stop such self-medication of Homoeo drugs by him when anticipated cure does not come and conditions of the patient deteriorate and causing distress? 4. Whether the Homoeopathic drugs of even high potencies can be sold freely to the public as over the counter drugs without the prescription from the qualified Homoeo Medical practioner? 5. Whether the Homoeopathic drugs also can be prescribed by a Registered Medical Practioner of any other fields of medicine who do not possess the Homoeopathic Educational qualification or Registration. The action against such persons even if one is treating family members can be taken only after the complaint is given to the State Boards. The sale of homoeopathic drugs is controlled by Drug and Cosmetic Act and is required to be sold on the prescription of qualified homoeopathic doctor having registration number. However some of the homoeopathic drugs have been notified by Govt. of India as OTC (0ver the counter product), only such drugs can be sold without prescription. |
